Two counts of DUI child endangerment and one count of DUI over .08 have been filed against Jill Spiva, the former principal of Addison Elementary School, seven months after she allegedly sideswiped a truck while driving with children in her SUV near the school.

The charges came only after the victim's family provided dash-cam footage and pushed the Cobb County Solicitor General's Office to act, according to WSB-TV Channel 2, which reported the new charges Saturday, Aug. 22.

The crash happened in January at the intersection of Ebenezer Road and Sandy Plains Road, a short distance from Addison Elementary. Cobb County police found a half-empty bottle of vodka behind the driver's seat of Spiva's black SUV after the collision. Spiva resigned as principal shortly after the original DUI charge.

Officers initially did not recommend child endangerment charges because they said they were unaware children were in the vehicle. But the police report listed two kids, and a 911 caller told dispatchers at the time: "She's pulled over she's got a few kids in the car."

Rebecca Sumner, whose husband was driving the truck Spiva allegedly struck, said her husband told officers at the scene multiple times that two children were in Spiva's vehicle. He sustained whiplash and was prescribed physical therapy.

Sumner provided dash-cam footage to both WSB-TV and the Solicitor General's Office. She said officials initially told the family the footage was difficult to interpret. WSB-TV first reported on the presence of children in the vehicle in early August, and the new charges followed.

"I truly believe sharing this story as you did made a huge impact and made this happen," Sumner told WSB-TV after the charges were filed.

Under Georgia law, transporting a child under 14 while driving impaired is a separate criminal offense from DUI. Each child results in a separate charge, and the counts do not merge with the underlying DUI for sentencing. A first or second offense carries up to 12 months in jail and a fine up to $1,000 per count. With two child endangerment counts plus a DUI from the same arrest, the combined convictions could trigger habitual violator status and a five-year license suspension.

The case is pending. The Solicitor General's Office said it takes every case seriously but declined to comment further. Spiva has not made a public statement regarding the new charges, and the Cobb County School District has not commented.
